We are requesting a review of the denial of our request for the attachments to CPS FOIA N011050-051222. This is regarding Investigative report # 7820 of Eric Skalinder a known pedophile. It is in the public’s interest to see his method of grooming his students through text messages.

CPS is conjoining FOIA requests. The current request is for text messages used in an investigative report. CPS quotes the texts messages in the investigative report so there is no reason that the

originals could not be released.

We understand the need to redact information, but the contents of the text messages and evidence of this known pedophile are of public interest for the safety of children.

CPS is obstructing public safety in this matter.

Dear Mr. Mason:

The Public Access Bureau has received the enclosed Request for Review of the response by Chicago Public Schools (CPS) to a Freedom of Information Act (FOIA) request submitted by Dr. John Kugler. This office has determined that further action is warranted.

On May 12, 2022, Dr. Kugler submitted a FOIA request to CPS seeking copies of various records concerning a specific individual. On May 25, 2022, CPS responded that it had previously provided him with the requested records in response to a previous similar FOIA request. On June 6, 2022, Dr. Kugler submitted this Request for Review contesting the response by CPS, alleging that this request seeks records different from those referenced in CPS's response.

As required under section 9.5(c) of FOIA (5 ILCS 140/9.5(c) (West 2020)), please provide this office with unredacted copies of the requested records for this office's confidential review, together with a description of the efforts taken to locate responsive records, including the personnel consulted and repositories searched.

This information must be submitted to our office within seven (7) business days after receipt of this letter. Under FOIA, "[t]he Public Access Counselor shall forward a copy of the answer to the person submitting the request for review, with any alleged confidential information to which the request pertains redacted from the copy. The requester may, but is not required to, respond in writing[.]" 5 ILCS 140/9.5(d) (West 2020). If you claim that any portion of your written response is confidential, please send two versions of your response letter: a complete copy for this office's confidential review and a redacted version suitable for this office to forward to the requester.
